New Markets Tax Credits

We represent clients in obtaining a wide range of tax credits and incentives. Our partner, Paul Jones, was one of the first attorneys in Indiana to serve as lead counsel in the closing of financing using New Markets Tax Credits (NMTCs). The NMTC program provides tax credit equity financing primarily for real estate projects located in qualified low-income census tracts. Additionally, the NMTC program provides sponsors and developers of qualified projects with gap financing to complete development in distressed areas. Paul has served as lead counsel in over $250 million in NMTC financing. Representative projects include charter schools, a health and wellness center, a teaching hotel and conference center, various retail properties, a community center, a community college classroom and conference center, public television station headquarter buildings and a parking facility located adjacent to affordable housing.

We represent clients in obtaining NMTC financing by serving as lead counsel to close the overall financing for the project, which includes providing structuring advice, borrower’s counsel representation, assistance with approvals and corporate governance matters, and tax advice and any required legal opinions.
