Paul Jones was one of the first attorneys in Indiana to serve as lead counsel in the closing of financing using New Markets Tax Credits (NMTCs). The NMTC programs provides tax credit equity financing primarily for real estate projects located in qualified low-income census tracts. The NMTC program provides sponsors and developers of qualified projects with gap financing to complete development in distressed areas. Paul Jones has served as lead counsel in over $200 million in NMTC financing. Representative projects include charter schools, a health and wellness center, a teaching hotel and conference center, various retail properties, a community center, a community college classroom and conference center, public television station headquarter buildings and a parking facility located adjacent to affordable housing. The firm represents clients in obtaining NMTC financing by serving as lead counsel to close the overall financing for the project, which includes providing structuring advice, borrower’s counsel representation, assistance with approvals and corporate governance matters, and tax advice and any required legal opinions.
The firm routinely assists clients in obtaining other tax benefits such as tax abatement or other tax credits. The firm also represents clients in seeking to correct errors in real estate tax bills related to classification of property, application of proper tax rates, removal of penalties, and application of qualified deductions such as the homestead deduction or specialized deductions for certain activities such as fertilizer/pesticide storage, among others.
